T-Town Tech – End User License Agreement (EULA) for Managed Devices

 

1. Applicability

  • This Agreement applies universally to all enrolled devices, including but not limited to:
    • Computers (Windows, macOS, Linux, ChromeOS, virtual endpoints)
    • Mobile devices (iOS, iPadOS, Android, tablets, smartphones)
    • Peripheral & endpoint devices (Apple TV, Android TV, smart TVs, set-top boxes, kiosks, conference displays, smart signage, IoT appliances, printers, scanners, and any other device capable of MDM enrollment or monitoring)
  • Applies whether devices are company-owned or personally owned (BYOD).
  • Enrollment in the MDM is a non-negotiable condition of accessing company resources, including networks, data, email, applications, and systems.

2. Authority & Control

  • T-Town Tech, acting on behalf of its client organizations, reserves absolute and unrestricted authority over all enrolled devices.
  • T-Town Tech and its clients may, at their sole discretion and without notice:
    • Enforce configurations and restrictions.
    • Install, update, or remove applications.
    • Lock, disable, track, restrict, reset, or wipe devices in whole or in part.
    • Place devices into single-app mode, kiosk mode, signage mode, or lockdown (including devices such as Apple TV and similar endpoints).
  • End Users have no right to alter, remove, disable, or interfere with any security or management function. Any attempt to do so constitutes a violation of this Agreement.

3. Security Requirements

  • All enrolled devices must remain compliant with corporate security standards, including but not limited to: encryption, strong authentication, passcodes, VPN enforcement, firewall controls, antimalware, patching, and content filtering.
  • End Users must immediately report any lost, stolen, damaged, or compromised device.
  • Jailbreaking, rooting, or other unauthorized modification is strictly prohibited.
  • Non-compliance may result in immediate device disablement, lockout, or remote wipe.

4. Monitoring & Privacy

  • All enrolled devices are subject to continuous monitoring for compliance and security. This may include: installed applications, device health, configuration state, location, usage activity, network connectivity, and data flow.
  • End Users acknowledge:
    • Company-owned devices: No expectation of privacy. All usage may be logged, reviewed, or audited.
    • BYOD devices: Business-related data, apps, accounts, and configurations will be monitored and controlled. Personal data may be unintentionally impacted by compliance actions, for which T-Town Tech bears no responsibility.
  • Monitoring extends to non-traditional devices (Apple TV, kiosks, signage, IoT) where application restrictions, app usage, and configuration compliance may be enforced.

5. Acceptable Use & Responsibility

  • Enrolled devices are authorized solely for legitimate business purposes. Limited incidental personal use may be tolerated but must not interfere with security, compliance, or productivity.
  • The following are strictly prohibited:
    • Use of enrolled devices for illegal activity, harassment, fraud, or unauthorized disclosure of company data.
    • Installing unauthorized apps, bypassing security controls, or attempting to modify system restrictions.
    • Using managed devices for personal gain or activities unrelated to business functions.
  • The End User is fully and personally responsible for all activity conducted on their enrolled device, including misconduct, negligence, or violations of law.

6. Data Loss, Liability & Financial Responsibility

  • T-Town Tech and its client organizations assume no liability whatsoever for:
    • Loss of personal data, applications, or configurations due to enrollment, enforcement, restriction, reset, or wipe.
    • Device performance degradation caused by security or compliance requirements.
    • Any direct, indirect, incidental, or consequential damages arising from device enrollment, use, or misuse.
  • The End User explicitly agrees that:
    • All personal use of an enrolled device is at the End User’s sole risk.
    • T-Town Tech is not liable for any personal inconvenience, disruption, or financial impact caused by device management.
    • If End User actions (negligence, tampering, misuse, or non-compliance) result in damages to company systems, data, or devices, the End User may be held financially responsible for all associated costs, including but not limited to hardware replacement, data recovery, incident response, legal fees, and damages suffered by the client.

7. Termination of Access

  • At termination of employment, contract, or authorized access, all devices may be immediately restricted, locked, or wiped at T-Town Tech’s discretion.
  • Company-owned devices, including peripherals such as Apple TVs, kiosks, and signage hardware, must be returned immediately upon request.
  • On BYOD devices, all corporate apps, accounts, and data will be remotely removed, which may permanently impact personal data or settings.

8. Enforcement & Remedies

  • Violations of this Agreement may result in:
    • Immediate and permanent loss of access.
    • Disciplinary action by the client organization, including termination of employment or contract.
    • Civil or criminal legal action.
    • Recovery of damages and costs directly from the End User.
  • T-Town Tech reserves the unilateral right to modify, expand, or amend this Agreement at any time, without notice. Continued use of an enrolled device constitutes acceptance of the current version of this Agreement.

9. Governing Law & Jurisdiction

  • This Agreement shall be governed by and construed under the laws of the State of Oklahoma, United States, without regard to conflict-of-law principles.
  • The End User agrees that any disputes, claims, or legal proceedings related to this Agreement shall be brought exclusively in the courts of Tulsa County, Oklahoma.
  • The End User waives any objection to jurisdiction, venue, or forum non conveniens.

10. Acknowledgement of Risk

By enrolling or using an enrolled device, the End User explicitly acknowledges and accepts that:

  • All devices — including workstations, mobile devices, Apple TVs, IoT appliances, kiosks, digital signage, and other non-traditional endpoints — are subject to the same monitoring and enforcement policies.
  • Remote management actions (lock, disablement, restriction, or wipe) may occur without prior notice or consent.
  • Neither T-Town Tech nor its client organizations are liable for any loss, damages, inconvenience, or impact on personal data resulting from enforcement of this Agreement.
  • The End User accepts full personal responsibility and financial liability for any actions or negligence that compromise security, violate policies, or cause damage to company systems or data.
